Windows Phone prize draw for attendees at Qype Lucky Voice event

1. ELIGIBILITY: This promotion is open to any person resident in the UK who is 18 years of age or older at the time of entry.  Employees of Microsoft or its affiliates, subsidiaries, advertising or promotion agencies are not eligible, nor are members of these employees’ families (defined as parents, children, siblings, spouses and life partners). Any entries deemed to be offensive, abusive (including the use of profanity) or to contravene English law will not be included in the promotion. Users submitting such entries may be reported to Twitter, Facebook and/or the relevant legal authority (depending on how they have provided their entry).
2. TO ENTER: To be entered into the prize draw and be eligible to win the prize, in addition to meeting the eligibility criteria above, you must have attended the Qype Lucky Voice event on 2^nd June 2010 at Lucky Voice Karaoke bar in Islington, London and be a member of the Qype website. Only registered members of the Qype website can attend the Qype Lucky Voice event.

You then need to create some public content (options include but are not limited to a photo, video, blog or Tweet etc.) about the Qype Lucky Voice event and post a link to your content in the comment area of the webpage: www.mykindofphone.com/my-kind-of-karaoke. Content can include but is not limited to: a photo taken by you at the event; a review of the event on the Qype website (www.qype.co.uk); a blog post about the event on your own choice of public blog; or other content that references the event.

Only one (1) entry per person will be accepted. No purchase necessary to enter the promotion.  Entry constitutes full and unconditional acceptance of these Terms and Conditions.  Microsoft is not responsible for lost, corrupted or delayed entries.  Microsoft reserves the right to disqualify anyone in breach of these Terms and Conditions.

Entrants warrant that their entry is their original work, has not been copied from others, and does not violate the rights of any other person or entry.

1. TIMING: This promotion runs from 10.01:00 a.m. GMT on 3rd June 2010 until 16.59:59 p.m. GMT on 3rd June 2010 (inclusive).

4.    USE OF YOUR ENTRY: By submitting your entry you grant Microsoft and its affiliates an unlimited, irrevocable, worldwide, royalty-free, perpetual, non-exclusive right and license to use, reproduce, publish, modify, perform and display the entry and its content (for the avoidance of doubt, including a photograph submitted as a part of the entry) and linked to the mykindofphone webpage or any replacement or successor to such web page, any Microsoft sub domains, and in any marketing or advertising of any kind related thereto, in any medium now known or later developed.

Waiver of Moral Rights: By entering this competition you hereby irrevocably and unconditionally waive in perpetuity the benefit of any provision of law known as moral rights, the benefits of any provision of law known as “droit moral” or any similar law in any country of the universe.

Further Assurance: You hereby undertake and covenant to Microsoft to do all such further acts and execute all such further documents and instruments as Microsoft may reasonably require of you, at Microsoft’s own cost, to vest in or further assure to Microsoft the rights in your entry.

1. SELECTION OF WINNER: All valid entries will be submitted for the prize draw. One (1) winner will be selected by a random prize draw conducted by Microsoft’s agent, 33 Digital Communications at 17:01:00 on 3rd June 2010. Odds of winning depend on the number of entries received.  The winners will be contacted by Microsoft via the method they used to enter.  The winner may be asked to provide identification proving their eligibility before they are entitled to receive the prize. If a winner cannot be contacted, through no fault of Microsoft, within one (1) day after the first attempt to contact the potential winner, an alternative winner will be selected at random. The winner may be required to participate in further publicity or advertising.

1. GROUNDS FOR AUTOMATIC DISQUALIFICATION:  Microsoft will automatically disqualify any entrant who: (i) makes an entry which is incomplete or illegible or (ii) in excess of the entry limit described above.

1. 7. PRIZE: There will be one (1) prize in total and the prize will be an HTC HD Mini mobile phone.   Prizes are as stated and are not transferable.  No cash alternatives available. Microsoft reserves the right to substitute the prize with prize of equal or greater value.  Prize will be sent by Microsoft no later than twenty eight (28) days after the prize draw has been made by Microsoft.  If you accept a prize you will be liable for all applicable taxes relating to the prize.  Unless otherwise stated, prize is subject to its manufacturer’s warranty and/or terms and conditions.
2. 8. WINNER LIST: The winner will be required to supply his/her name and postal address to Microsoft for the purpose of prize fulfillment. The winner consents to his/her surname being made publicly available upon request. The winner’s name will be available upon request for a period of twenty eight (28) days after the final draw date by written request to wp@33-digital.com.

1. OTHER: No correspondence will be entered into regarding either this promotion or these Terms and Conditions. In the unlikely event of a dispute, Microsoft’s decision shall be final.  Microsoft reserves the right to amend, modify, cancel or withdraw this promotion at any time without notice.

1. GENERAL: If any provision or part of these terms is deemed void or otherwise unenforceable in law then that provision or part shall be deemed excluded and the remainder of these Terms shall remain in force.

GOVERNING LAW: These terms, the conduct of this promotion and the interpretation and enforcement of these terms and conditions shall be exclusively governed and construed in accordance with the laws of England and Wales, unless you are a Scottish resident, in which case you may choose the law of your own country of residence.  Entrants irrevocably submit to the exclusive jurisdiction of the Courts of England and Wales, unless they are a Scottish resident or a resident of Northern Ireland, in which case they may choose the courts of their place of residence.

SPIRIT OF THE COMPETITION: If you attempt to If you attempt to compromise the integrity or the legitimate operation of this promotion by hacking or by cheating or committing fraud in ANY way, we may seek damages from you to the fullest extent permitted by law. Further, we may ban you from participating in any of our future promotions, so please play fairly.
