Terms and conditions
1. ELIGIBILITY: This competition is open to any person resident in the United Kingdom who is eighteen (18) years of age or older at the time of entry and is a registered member of and contributor to a blog, or is a registered member of the website Facebook http://www.facebook.com (the “Website“). IF YOU ARE NOT A REGISTERED MEMBER OF A BLOG OR THE WEBSITE YOUR ENTRY WILL NOT BE VALID AND YOU WILL NOT BE ABLE TO WIN A PRIZE. Employees of Microsoft or its affiliates, subsidiaries, advertising or promotion agencies are not eligible, nor are members of these employees’ families (defined as parents, children, siblings, spouse and life partners).
2. TO ENTER: If you are not a registered member of a blog, you must be a registered member of the Website. In order to register with the Website go to http://www.facebook.com and follow the instructions. To be eligible to win a prize you must write and publish your own review of one (1) of the six (6) ‘Must Have Games’ (Hydro Thunder GO, Doodle Jump, geoDefense, Angry Birds, Plants vs. Zombies, Sonic the Hedgehog 4: Episode 1). The post should review the game in your own words and explain why the game you have chosen to review is your favourite of the six (6) Must Have Games. Entrants warrant that their review is their original work, has not been copied from others, and does not violate the privacy, intellectual property rights or other rights of any other person or entity.
The review must be posted on either a personal blog or Facebook ‘note’ within the time period set out in Section 3 below. Once published, the link to your review should be submitted to the Windows Phone UK team either by Twitter, via a tweet to @WindowsPhoneUK; or by Facebook, via a wall post on the WindowsPhoneUK page;or by our blog at www.mykindofphone.com via a comment beneath our post announcing this competition.
Any entries received outside of the Competition Period set out in section 3 below will not be entered into the competition. Any entries received which are reported to violate any of the terms of use of the Website will not be entered into the prize draw. Any entries deemed by Microsoft to be offensive, abusive (including the use of profanity) or to contravene these Terms and Conditions or English law will not be included in the competition. Incomplete, damaged, defaced or illegible entries may be deemed invalid at the sole discretion of Microsoft. Please do not spam your friends.
Each review published either as a blog post or Facebook ‘note’ will be deemed as one (1) entry per person into the competition. Only one (1) entry per person will be accepted. If you enter the competition using multiple accounts on the Website or via a blog then you will only be entitled to the first prize if any awarded to you. Unclaimed prizes will be re-entered to a prize draw and allocated to an alternative entrant at random. No purchase necessary to enter the promotion. Entrants consent to their entries appearing on the Windows Phone UK Facebook page and/or My Kind of Phone blog, at Microsoft’s sole discretion.
Entry constitutes full and unconditional acceptance of these Terms and Conditions. Microsoft is not responsible for lost, corrupted or delayed entries. Microsoft reserves the right to disqualify anyone in breach of these Terms and Conditions.
3. TIMING: This competition runs for one (1) week from 17.01:00 p.m. GMT on 30 June 2011 until 4.59:59 p.m. GMT on 7 July 2011 (inclusive) (the “Competition Period”). To be eligible, all entries must be received by 4.59:59 p.m. GMT on 7 July 2011 after which they will be reviewed by Microsoft’s agent 33 Digital and representatives from the Windows Phone UK team on 7 July 2011 as described in paragraph 4 below.
4. SELECTION OF WINNERS: All valid entrants will be eligible for shortlisting. Shortlisting of three entries is to be conducted by Microsoft’s agent 33 Digital and representatives from the Windows Phone UK team on 7 July 2011. The shortlisting will be performed using the following criteria: (i) originality (ii) relevancy to question (iii) adherence to the terms of the competition (iv) humour. These three shortlisted entries will then be posted to the Windows Phone UK Facebook fan page, where the public can vote by selecting ‘like’ to indicate they vote for a specific post. People voting can ‘like’ more than one of the three shortlisted entries, but can only ‘like’ each one a single time; multiple votes by one person to a single entry will not be counted. The winner will be determined by the number of ‘likes’ attributed to that entry on the Windows phone UK Facebook fan page. The entry with the highest number of ‘likes’ by 4.59:59 p.m. GMT on 8 July 2011 will be deemed the winner. Microsoft will endeavour to contact the chosen winner via email, Twitter, Facebook or the My Kind of Phone blog as appropriate. All potential winners may be asked to provide identification proving their eligibility before they are entitled to receive the prize. If the chosen winner cannot be contacted, through no fault of Microsoft, within twenty-four (24) hours after the first attempt to contact the potential winner, an alternative winner will be selected (the entry with the second highest number of votes, or, if uncontactable, the entry with the third highest number of votes). The winner may be required to participate in further publicity or advertising. Odds of winning depend on the number of entries received.
5. GROUNDS FOR AUTOMATIC DISQUALIFICATION: Microsoft will automatically disqualify any entrant who: (i) makes an entry which is incomplete or illegible or (ii) in excess of the entry limit described above.
6. USE OF DATA: Personal data which you provide when you enter the draw will only be used to contact you in relation to this competition.
7. PRIZE: There will be one (1) prize package in total for one (1) winner. The prize package for the competition is an Xbox 360 with Kinect and a Windows Phone, and will be allocated at the end of the Competition Period. The Xbox 360 prize is a 250 GB console only; no other games will be supplied. No accessory except the Kinect will be supplied. The Windows Phone prize is a HTC 7 Mozart handset only, without network subscription. Prize is as stated and is not transferable. No cash alternatives available. Microsoft reserves the right to substitute the prize with a prize of equal or greater value. The prize will be sent by Microsoft no later than 28 days after the winner has been selected. Prizes may be considered a taxable benefit and winners will be directly responsible for accounting for any tax liability arising on their prize. Unless otherwise stated, the prize is subject to their manufacturer’s warranty and/or terms and conditions.
8. WINNERS LIST: The winner will be required to supply his/her name and postal address to Microsoft for the purpose of prize fulfilment. The winner consents to his/her surname being made publicly available upon request. The winner’s name will be available upon request for a period of 28 days after the final draw date by written request to wp@33-digital.com.
9. OTHER: No correspondence will be entered into regarding either this competition or these Terms and Conditions. In the unlikely event of a dispute, Microsoft’s decision shall be final. Microsoft reserves the right to amend, modify, cancel or withdraw this competition at any time without notice.
If any provision or part of these terms is deemed void or otherwise unenforceable in law then that provision or part shall be deemed excluded and the remainder of these Terms shall remain in force.
Microsoft cannot guarantee the performance of any third party and shall not be liable for any act or default by a third party. Participants in this competition agree that Microsoft will have no liability whatsoever for any injuries, losses, costs, damage or disappointment of any kind resulting in whole or in part, directly or indirectly from acceptance, misuse or use of a prize, or from participation in this promotion. Nothing in this clause shall limit Microsoft’s liability in respect of death or personal injury arising out of its own negligence or arising out of fraud.
10. GOVERNING LAW: These terms, the conduct of this competition and the interpretation and enforcement of these terms and conditions shall be exclusively governed and construed in accordance with the laws of England and Wales, unless you are a Scottish resident, in which case you may choose the law of your own country of residence. Entrants irrevocably submit to the exclusive jurisdiction of the Courts of England and Wales, unless they are a Scottish resident or a resident of Northern Ireland, in which case they may choose the courts of their place of residence.
11. SPIRIT OF THE COMPETITION: If you attempt to compromise the integrity or the legitimate operation of this competition by hacking or by cheating or committing fraud in ANY way, we may seek damages from you to the fullest extent permitted by law. Further, we may ban you from participating in any of our future promotions, so please play fairly.
